SINGYACHTS TERMS & CONDITIONS

Welcome to SingYachts. These Terms & Conditions (“Terms”) govern your access to and use of our yacht charter services, website, and related offerings (collectively, the “Services”). By booking a charter, making a payment, or using our Services, you agree to be bound by these Terms, which constitute a legally binding agreement between you (“Client” or “You”) and SingYachts (“We”, “Us”, or “Our”).
Please read these Terms carefully before making any booking. If you do not agree to these Terms, you may not use our Services.
1. Booking & Payment
1.1. Pricing: All prices are indicated in Singapore Dollars (SGD) and are net. Prices may be subject to change without prior notice; however, confirmed bookings will honor the agreed price.
1.2. Booking Confirmation Deposit: To secure your chosen yacht and date, a non-refundable deposit is required at the time of booking. This deposit amount is equivalent to the charter fee for the minimum number of passengers required for the selected yacht (e.g., 10 passengers for most yachts, while some yachts may allow a minimum booking of 5 passengers). The specific minimum passenger requirement and corresponding deposit amount will be clearly communicated during the booking process.
1.3. Confirmation of Booking: Bookings are confirmed only upon receipt of full payment. Payment terms are immediate unless otherwise mentioned, and all bookings are handled on a first-come-first-serve basis.
1.4. Last-Minute Bookings: For bookings made within 3 days of the charter date, full payment is required immediately upon confirmation.
1.5. Payment Methods: We accept payments via Bank transfer, PayNow, credit card (Visa/Mastercard).But please note that credit card payments incur additional 3.9% processing fee by the payment processor.
1.6. Guest Count Policy:
a. Children or infants are counted as 1 pax (passenger).
b. No refunds will be issued for a shortfall of guests on the charter date. If the final guest number is unconfirmed, we recommend booking for the minimum required number of passengers.
c. Additional guests can be added up to the yacht’s maximum licensed capacity by informing SingYachts at least 2 days in advance and paying the difference in charter fees.
2. Cancellation & Rescheduling
2.1. Cancellation by Client:
a. All bookings are strictly non-cancellable by the Client once confirmed. Any cancellation by the Client for any reason will result in the forfeiture of all payments made (deposit and/or full payment).
b. Guests who do not show up for their scheduled charter (no-shows) will result in the forfeiture of the full payment, and no refunds will be issued.
c. Any refunds, if applicable (e.g., as per 2.3 below), shall only apply to the charter fee component. Charges for food catering or other services will not be refunded should the charter be cancelled or rescheduled for any reason.
d. All time-sensitive communication regarding cancellations or rescheduling must occur within SingYachts’ office hours to be counted towards the effective period. Communication made after office hours will be counted beginning from the next working day.
2.2. Wet Weather Policy & Rescheduling (Initiated by Captain/SingYachts):
a. Rescheduling or cancellation based solely on weather forecasts without being present at the marina for the charter is not permitted.
b. On the day of the charter, the Captain will make the final decision on whether it is safe to sail. Guests are required to be at the marina at the scheduled time for guidance from the Captain/crew.
c. If sailing is deemed unsafe by the Captain, they will first attempt to delay the charter (if conditions are expected to improve) or reschedule to a later date (subject to availability).
d. No outright cancellations are allowed due to weather, except if the Captain deems sailing impossible. In such extreme cases, an alternative date will be offered. Any applicable refunds may be made in the form of a cash refund or credit refund, at SingYachts’ discretion.
e. Rescheduling is permitted only due to bad weather as advised by the Captain on the day of the charter.
f. In cases where rescheduling is allowed:
i. If switching to a date with a higher charter rate, customers must pay the price difference.
ii. If switching from a higher-value charter (e.g., weekend) to a lower-value charter (e.g., weekday), no refunds (whether cash or credit) on the difference of the charter fees will be provided.
2.3. Cancellation by SingYachts (Other Reasons):
a. Mechanical Issues / Unforeseen Circumstances: In the rare event of mechanical issues with the yacht or other unforeseen circumstances beyond our control that prevent the charter from proceeding, SingYachts will:
* Negotiate with Yacht owner and attempt to arrange a suitable replacement yacht of comparable size and standard.
* If no suitable replacement can be arranged, a full refund will be issued(subjected to yacht owner approval / consent. Any applicable refunds may be made in the form of a cash refund or credit refund, at SingYachts’ discretion.
b. Client Misconduct: Yacht captain reserves the right to terminate a charter without refund if the Client or any guest violates these Terms, engages in illegal activities, or poses a safety risk.
3. Yacht Breakdown / Mechanical Failure During Charter
3.1. In the unfortunate and rare event of a mechanical breakdown or significant unforeseen technical issue with the yacht during an ongoing charter, SingYachts in coordination with the respective yacht owner will make every reasonable effort to:
a. Safely return the yacht and its guests to the nearest safe port or embarkation point.
b. Coordinate with the yacht owner to arrange for a replacement charter on a comparable yacht for the remaining duration of the original charter, subject to availability and approval of the yacht owner or captain in-charge (where it is reasonable to do so)
3.2. Refund Policy for In-Progress Breakdowns:
a. If the charter is terminated due to a breakdown and has been almost fulfilled (as defined below), no refunds will be issued.
b. If the charter is terminated due to a breakdown and has not been almost fulfilled, SingYachts will try to negotiate with the owner to offer a prorated refund for the unfulfilled portion of the charter duration, or a partial credit towards a future booking, at our discretion.
c. Definition of “Almost Fulfilled”: A charter is considered “almost fulfilled” if the breakdown occurs during the return trip after 3 hours of the charter have been completed.
3.3. SingYachts shall not be liable for any indirect, consequential, or incidental damages, expenses, or losses incurred by the Client or guests due to a mechanical breakdown, beyond the value of the unfulfilled charter portion as per clause 3.2. This explicitly includes, but is not limited to, any claim for reimbursement or compensation for the Client’s or guests’ time, or for delays causing disruption to their other personal or professional obligations arising from such breakdown.
4. Scope of Services / Inclusions
4.1. Charter Rate Inclusions: All rates listed are for basic charters only (typically 4-5 hours, depending on the specific yacht). Unless otherwise stated, charter rates include:
* A standard itinerary, typically anchoring at a location somewhere between Lazarus Island and St. John’s Island.
* Fuel (for standard itinerary)
* Crew services
* Complimentary toys (e.g., kayak, SUP, floating mats, where available on the specific yacht).
4.2. Additional Anchoring Costs: If customers, after the initial anchoring, change their mind and request to move to another anchoring location (even if it’s nearby), this will incur an additional cost. The specific amount will be communicated to you by the captain, quoted on a case-by-case basis depending on distance and time”.
4.3. Exclusions: Charter rates do not include food and drinks. BBQ pit and cooking services DO NOT include food. Ice (unless otherwise stated), disposable cutlery, or cups are also not provided.
4.4. Complimentary Toy Availability Note: Complimentary toys are subject to availability on the day of the charter. Malfunctions arising from previous charters or unforeseen maintenance may limit immediate replacement or the provision of an alternative.
5. Charter Duration & Schedule
5.1. Punctuality: Customers are required to arrive at least 15 minutes early for their scheduled charter time. Charter durations begin and end strictly at the booked times.
5.2. Delays Caused by Client: Any delay caused by the customer or their guests will lead to a corresponding delay in the charter’s departure. Although the yacht may sail out later, it will still end as initially scheduled, and no compensation for time delays will be provided.
5.3. Late Return: Any delay in returning the yacht beyond the agreed-upon charter end time may incur additional charges [Depending on the yacht for minimum 1hr and any late night charges where applicable].
5.4. Embarkation/Disembarkation: All guests must embark and disembark at the designated points only, as agreed with SingYachts prior to the charter. Disembarkation at Lazarus Island Pontoon is generally not permitted by MPA unless the specific yacht has a tender boat.
6. Use of Yacht & Client Responsibilities
6.1. Guest Capacity: The maximum number of guests on board is strictly limited to the yacht’s licensed capacity, as stipulated in your booking confirmation. This limit cannot be exceeded under any circumstances.
6.2. Prohibited Items & Activities: The following are strictly prohibited on board:
a. Illegal drugs, narcotics, or any controlled substances.
b. Weapons, firearms, or any dangerous goods.
c. Any form of gambling or illegal activities.
d. Balloons and confetti are strictly prohibited inside the Marina premises and on all yachts due to marine life preservation. If caught by Marina staff, the customer must pay any penalties imposed by the respective Marina.
e. Physical and verbal abuse of staff.
6.3. Client Conduct: The Client is responsible for the conduct of all guests on board. Any unruly, disruptive, or unsafe behavior may result in the immediate termination of the charter without refund.
6.4. Damage to Yacht: The Client is responsible for ensuring guests do not damage the chartered yacht. The Client shall be liable for any damage to the yacht, its equipment, or fittings caused by the negligent or willful acts of the Client or their guests. Costs for repair or replacement will be charged to the Client.
6.5. Safety Briefing: All guests must attend and comply with the safety briefing conducted by the Captain or crew prior to departure.
6.6. Children Supervision: Children under 12 years old must be supervised by a responsible adult at all times. Life jackets must be worn by children during cruising and water activities.
6.7. Onboard Rules:
a. Footwear is not permitted onboard. For your convenience, footwear will be collected by the crew upon your embarkation and safely stored in a designated box onboard.
b. Unless otherwise stated, red wine is also not permitted onboard all our yachts to prevent staining.
c. Smoking is not allowed inside the yacht. Designated outdoor smoking areas must be checked with the Captain.
d. Alcohol Consumption: Moderate alcohol consumption is allowed. Guests are expected to maintain reasonable behavior and avoid actions that endanger others. The Captain has the right to return to the marina and terminate the charter for disruptive behavior. No refunds or compensation will be provided in such cases.
6.8. Food & Beverage:
a. BYO (Bring Your Own): Clients are permitted to bring their own food and non-alcoholic beverages without corkage fees.
b. Catering/BBQ: Catering services can be arranged through SingYachts at an additional cost(from third party vendors), or clients may arrange their own catering after informing us.
c. No Refunds for F&B: No refunds will be issued for food and beverages ordered during booking in case of cancellation or reschedule for any reason. You may choose to take them away, but packing and arrangements are your(Clients) responsibility.
d. Cleaning Fee: Excessive mess may incur an additional cleaning fee.
6.9. Pets: Pets are allowed on designated pet-friendly yachts only, with prior notification to SingYachts at the time of booking. Strict adherence to the following rules is required:
a. Pets are not permitted inside the yacht cabin(s).
b. Pets are not permitted on water toys (e.g., kayaks, stand-up paddleboards, floating mats).
c. Pets must wear a diaper throughout the entire duration of the charter.
d. Pets must be kept on a leash at all times while on board the yacht. e. An additional cleaning fee may apply, and the Client is fully responsible for any damage or mess caused by pets.
6.10. Guest Indemnity Form: The Client acknowledges that, for safety and legal compliance, they and all guests on board may be required to sign an indemnity form provided by the respective yacht owner/operator prior to embarkation. This form will detail the terms of use specific to that yacht. Failure to complete and sign this form may result in refusal of boarding without refund.
7. Safety & Captain’s Authority
7.1. Captain’s Authority: The Captain of the yacht has absolute authority over the vessel and its crew and guests. The Captain’s decisions regarding safety, navigation, and the itinerary are final and must be respected by all on board. Clients must follow the Captain’s instructions for safety and a comfortable ride.
7.2. Itinerary Changes: The Captain may alter the itinerary, cancel water activities, or return to port early if safety is compromised due to weather, sea conditions, mechanical issues, or any other reason deemed necessary for the safety of the yacht and its occupants. Such decisions are at the Captain’s sole discretion and will not be subject to refund or compensation. This includes any claim for inconvenience, delay, or disruption to the Client’s or guests’ time or other personal obligations.
7.3. Compliance with Laws: All guests must comply with Singapore’s maritime laws and regulations.
7.4. Water Activities Rules:
a. Guests engage in water activities at their own risk; SingYachts is not liable for injury, damage, or loss of personal items.
b. Water activities are not allowed after 6:30 PM or in bad weather conditions.
c. Life jackets are provided and must be worn by all participants during water activities.
7.5. Guest Preparation: If you are participating in water activities, please bring your own towels and a change of clothes to freshen up.
8. Liability & Indemnity
8.1. Role of SingYachts as Aggregator: SingYachts operates as an aggregator platform, connecting clients with independent yacht owners and operators. While we diligently vet all listed yachts for quality, safety standards, and compliance with statutory requirements before listing them, the primary operational responsibility for the safety, security, maintenance, and conduct of the crew during the charter lies with the respective yacht owner/operator.
8.2. Limitation of SingYachts’ Liability: SingYachts, its owners, employees, and agents shall not be liable for any personal injury, death, loss, or damage to property (including personal belongings) incurred by the Client or any guest during the charter, unless directly and solely caused by the gross negligence or willful misconduct of SingYachts itself in its capacity as an aggregator. Our liability for any claim arising from the charter services provided by the yacht owner/operator is limited to the fullest extent permitted by Singapore law.
8.3. Client Indemnity: The Client agrees to indemnify and hold harmless SingYachts from and against any and all claims, demands, liabilities, damages, costs, and expenses (including legal fees) arising out of or in connection with the Client’s or their guests’ actions, omissions, or breach of these Terms, or any actions of the yacht owner/operator that are beyond SingYachts’ direct control as an aggregator.
8.4. Force Majeure: SingYachts shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, epidemics, government regulations, or severe weather conditions. No compensation will be provided for any inconvenience, delay, or disruption to the Client’s or guests’ time or other personal obligations arising from such events..
9. Insurance
9.1. Yacht Insurance Coverage: All yachts listed on the SingYachts platform are diligently verified to be appropriately insured by their respective yacht owners/operators. This coverage includes the vessel itself and third-party liabilities, as mandated by Singapore’s maritime laws and regulations. SingYachts itself does not maintain insurance coverage for the individual yachts or their specific third-party liabilities, as our role is to facilitate bookings between clients and these independently managed yacht owners/operators.
9.2. Clients are strongly and unequivocally advised to obtain their own comprehensive travel insurance, personal accident insurance, or other relevant personal insurance policies to cover unforeseen circumstances, personal belongings, medical emergencies, and any other potential liabilities during the charter. SingYachts’ liability, as an aggregator, is limited as per Section 8.
10. Data Protection & Privacy
10.1. SingYachts collects and processes personal data in accordance with the Personal Data Protection Act 2012 (PDPA) of Singapore.
10.2. Information collected during the booking process will be used for charter arrangements, communication, and service improvement. We will not share your personal data with third parties without your consent, except as required by law.
10.3. By using our Services, you consent to the collection and use of your personal data as outlined in our Privacy Policy .
11. Governing Law & Dispute Resolution
11.1. These Terms shall be governed by and construed in accordance with the laws of Singapore.
11.2. Any dispute, controversy, or claim arising out of or relating to these Terms or your use of our Services shall first be resolved through good faith negotiation between the parties.
11.3. If a resolution cannot be reached through negotiation, the parties agree to refer the dispute to mediation administered by the Singapore Mediation Centre (SMC) in accordance with its prevailing Mediation Procedure.
11.4. If mediation is unsuccessful, the dispute shall be submitted to the exclusive jurisdiction of the Courts of Singapore.
12. Amendments to Terms
12.1. SingYachts reserves the right to amend or update these Terms at any time without prior notice. The latest version of the Terms will be posted on our website.
12.2. Your continued use of our Services after any amendments signifies your acceptance of the updated Terms.
